1. Acceptance of Terms

By accessing or using AI Image Editor (“we”, “us”, “our”, or the “Service”), you agree to these Terms of Service. If you are using the Service on behalf of an organization, you confirm that you have authority to bind that organization to these terms.

2. Our Services

AI Image Editor provides browser-based tools for background removal, text replacement inside images, and AI-powered upscaling. We continually enhance the platform and may introduce new features, modify existing ones, or retire functionality with reasonable notice where practical.

3. Accounts & Eligibility

  • You must be at least 13 years old (or the age of digital consent in your jurisdiction) to create an account.
  • You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
  • Please notify us immediately if you suspect unauthorized access to your account.

4. Your Content & Responsibilities

  • You retain ownership of images and assets you upload. You grant us a limited license to process those files solely to deliver the requested outputs and to operate the Service.
  • You represent that you have the rights, licenses, and permissions needed to use any content you submit. Do not upload materials that infringe the intellectual property or privacy rights of others.
  • You agree not to use the Service to create misleading, defamatory, hateful, or illegal content, or to test, benchmark, or reverse engineer our platform in ways that violate applicable law.

5. Fair Use & Usage Limits

  • The Free plan includes unlimited background removal and a monthly allowance for other AI tasks. Creator and Studio plans expand those allowances.
  • If your usage materially exceeds the allowances set out on the Pricing page, we may throttle processing speeds, require an upgrade, or discuss a custom agreement.
  • We reserve the right to suspend accounts that abuse rate limits, automate requests beyond reasonable levels, or compromise system stability.

6. Payments and Renewals

  • Paid subscriptions renew automatically at the end of each billing cycle unless you cancel before the renewal date.
  • Fees are non-refundable except where required by law. Downgrades take effect at the next renewal.
  • Credit packs are billed once and remain available until they expire according to the terms shown at purchase.

7. Service Changes & Availability

We may modify, suspend, or discontinue any part of the Service at any time. When we make material changes, we will provide notice through the app, by email, or via our changelog. We are not liable if the Service is unavailable due to maintenance, outages, or events beyond our control.

8. Intellectual Property

  • We retain all rights, title, and interest in the AI Image Editor platform, including software, interfaces, documentation, and underlying machine learning models.
  • You may not copy, modify, distribute, or reverse engineer our technology unless permitted by law.
  • Generated outputs belong to you, provided you hold the rights to the original inputs and comply with these Terms.

9. Disclaimer of Warranties

The Service is provided “as is” and “as available.” We make no warranties—express, implied, or statutory—about accuracy of AI outputs, uninterrupted availability, or fitness for a particular purpose. You are responsible for validating results before using them in production or publication.

10. Limitation of Liability

To the fullest extent permitted by law, AI Image Editor will not be liable for indirect, incidental, special, consequential, or punitive damages, nor for lost profits or revenue. Our total aggregate liability for any claim arising out of or relating to the Service is limited to the amounts you paid to us in the 12 months preceding the event giving rise to the claim.

11. Indemnification

You agree to defend and indemnify AI Image Editor, its affiliates, and their respective officers, employees, and agents from any claims, damages, liabilities, and expenses (including legal fees) arising from your content, your use of the Service, or your violation of these Terms.

12. Governing Law & Disputes

These Terms are governed by the laws of the State of California, United States, without regard to its conflict of law provisions. Any dispute will be resolved in the state or federal courts located in California, and you consent to their jurisdiction.

13. Changes to These Terms

We may update these Terms from time to time. When we make material changes we will provide notice and update the “Last updated” date above. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
